1. Acceptance of Terms
By creating an account or using Base8Ball (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms form a binding agreement between you and the operator of Base8Ball ("we," "us," or "our").
2. Description of Service
Base8Ball is a web-based implementation of classic tabletop baseball simulation. The Service includes exhibition games (free), online league play, keeper leagues, custom card generation, and associated features. Free-tier access is provided to classic seasons and exhibition play. League creation and participation require an active subscription.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information when registering. You may not share your account with others or create accounts for the purpose of circumventing access restrictions.
You may delete your account at any time from your account settings. Upon deletion, your personal data will be anonymized as described in our Privacy Policy. League history created under your account may be retained in anonymized form.
4. Subscriptions and Payment
Subscriptions are annual and grant access to premium features for one year from the date of payment. Payments are processed by Stripe. Subscription fees are non-refundable except as required by applicable law or as expressly stated at the time of purchase.
Prices may change at renewal. We will provide reasonable notice before any price change takes effect. Your continued use of the Service after a price change constitutes acceptance of the new price.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Attempt to gain unauthorized access to any system or account.
- Interfere with the integrity or performance of the Service.
- Harvest or scrape data from the Service by automated means.
- Impersonate another person or entity.
- Upload or transmit malicious code.
We reserve the right to suspend or terminate accounts that violate these terms.
6. Intellectual Property
The Service, including its code, design, and original content, is owned by us and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our written permission.
Statistical data used in player cards is derived from publicly available historical baseball records. The Statis Pro Baseball game system is the property of its respective rights holders; Base8Ball is an independent digital implementation and is not affiliated with or endorsed by those rights holders.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
9. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including intellectual property rights, disclaimers, and limitations of liability.
10. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law provisions. Any dispute arising from these Terms will be resolved in the courts of Texas.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email to registered users or by a prominent notice within the Service. Your continued use after notice constitutes acceptance of the revised Terms.
